1. Data Controller

The Controller has not appointed a Data Protection Officer. For all matters relating to the processing of personal data, please contact the Controller directly.

2. Categories of personal data

Depending on the nature of the enquiry or service, the Controller may process in particular:

• your first and last name, email address and telephone number;
• your residential, correspondence or business address;
• company name, job title, tax identification number and details of persons representing a business client;
• the content of your enquiry, correspondence, contact history and arrangements made;
• information concerning a property being sought, sold, leased, rented or purchased, including its address, legal status, specifications, price and documentation;
• preferences concerning a property, interior design project or planned development;
• interior design materials, including floor plans, measurements, photographs, visualisations and project documentation;
• data required to prepare and perform a contract, settle fees and issue accounting documents;
• data concerning attorneys-in-fact, representatives, beneficial owners and other persons involved in a transaction;
• data contained in identity documents - only where processing is required under anti-money laundering and counter-terrorist financing laws;
• information recorded in the CRM system concerning enquiries, offers, arrangements and services provided.

Please do not provide information that is unnecessary for handling your enquiry or providing the service, in particular data concerning health, political opinions, religious beliefs or other special categories of personal data.

3. Purposes and legal bases of processing

Personal data may be processed for the following purposes:

• receiving and handling enquiries, replying and conducting correspondence - on the basis of the Controller's legitimate interest in communicating with persons interested in her business and services, under Article 6(1)(f) GDPR;
• preparing an offer and taking steps before entering into a contract concerning the brokerage of a sale, purchase, lease or rental of real estate, interior design and arrangement, or consulting and advisory services for property developers - under Article 6(1)(b) GDPR;
• entering into and performing a contract, including identifying the client's needs, presenting or selecting properties, coordinating a transaction, preparing an interior design, providing consulting services, making arrangements and settling fees - under Article 6(1)(b) GDPR;
• communicating with persons representing clients, contractors, property developers or other entities involved in providing the service - on the basis of the Controller's legitimate interest in entering into and performing contracts and maintaining business relationships, under Article 6(1)(f) GDPR;
• complying with legal obligations, in particular tax and accounting obligations and, where required by law, obligations concerning anti-money laundering and counter-terrorist financing, including identifying and verifying the client and beneficial owner - under Article 6(1)(c) GDPR;
• establishing, pursuing or defending legal claims, preventing misuse and documenting arrangements - on the basis of the Controller's legitimate interest, under Article 6(1)(f) GDPR.

Personal data is not used to send newsletters or electronic marketing communications without obtaining the consent required by law.

4. Sources of personal data

Personal data is primarily obtained directly from the data subject through the contact form, email, telephone, meetings or a contract.

In connection with the services provided, personal data may also be obtained:

• from another party to a proposed or ongoing transaction;
• from the owner, purchaser, tenant or landlord of a property;
• from a property developer, contractor, a person representing a client or a cooperating real estate agent;
• from publicly available registers, such as the Polish Central Register and Information on Business (CEIDG), National Court Register (KRS) or land and mortgage registers;
• from documents provided in connection with a property, project or transaction.

5. Requirement to provide personal data

Providing personal data through the contact form is voluntary. However, information marked as mandatory is necessary to receive and handle the enquiry. Failure to provide it may prevent the Controller from responding.

Providing data required to enter into and perform a contract is voluntary but necessary for the selected service to be provided.

Where the obligation to provide data arises from law - in particular tax, accounting, anti-money laundering or counter-terrorist financing laws - refusal to provide it may prevent the Controller from entering into a contract, providing the service or completing the transaction.

6. Recipients of personal data

Personal data may be disclosed, only to the extent necessary for the stated purposes, to:

• LH.pl Sp. z o.o., pl. Wolności 6/4, 61-738 Poznań, Poland, NIP: 7831711517 - the provider of email services;
• HubSpot, Inc., Two Canal Park, Cambridge, MA 02141, USA - the provider of the CRM system used to manage enquiries, contacts, offers and client relationships;
• providers of IT, maintenance and technical services;
• providers of accounting, tax, legal, insurance or advisory services;
• persons and entities involved in the relevant real estate transaction, in particular owners, purchasers, sellers, tenants, landlords, property developers, cooperating real estate agents and notarial offices;
• designers, contractors, valuers, photographers, industry specialists and other collaborators involved in the project or service, where this is necessary and consistent with the scope of the engagement;
• public authorities, courts, tax authorities, the Polish General Inspector of Financial Information or other authorised bodies, where disclosure is required by law.

Service providers acting for the Controller receive access to personal data only to the extent necessary to perform their assigned tasks.

7. Transfers outside the European Economic Area

In connection with the use of HubSpot, personal data may be transferred to, or accessed from, the United States.

HubSpot, Inc. declares that it participates in the EU-U.S. Data Privacy Framework. Where that mechanism does not apply to a particular transfer, the transfer is based on the Standard Contractual Clauses approved by the European Commission and incorporated into the data processing agreement with HubSpot.

8. Retention periods

Personal data will be retained:

• for enquiries that do not result in a contract - for the period necessary to handle the enquiry, but no longer than 12 months from the last contact, unless earlier deletion is possible and appropriate;
• for steps taken before entering into a contract - until the discussions or negotiations end and subsequently for the period necessary to protect against potential claims;
• where a contract is entered into - for the duration of its performance and, after its termination, until the limitation period for potential claims expires;
• for accounting and tax records - for the period required by applicable law;
• for records required under anti-money laundering and counter-terrorist financing laws - for five years from the end of the business relationship with the client or the date of an occasional transaction;
• where processing is based on a legitimate interest - until that interest ceases or an effective objection is raised, whichever occurs first;
• where processing is based on consent - until consent is withdrawn, unless another legal basis permits continued retention.

9. Your rights

Subject to the conditions set out in the GDPR, you have the right to:

• receive information about the processing of your personal data;
• access your personal data and receive a copy;
• rectify or complete your personal data;
• request erasure of your personal data;
• request restriction of processing;
• data portability, where processing is based on consent or a contract and is carried out by automated means;
• object to processing based on the Controller's legitimate interests;
• withdraw consent at any time, where processing is based on consent.

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal. To exercise your rights, contact the Controller at contact@seewellhome.com.

10. Right to lodge a complaint

If you believe that your personal data is being processed unlawfully, you may lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stanisława Moniuszki 1A, 00-014 Warszawa, Poland, www.uodo.gov.pl/en.

11. Automated decision-making

The Controller does not make decisions concerning data subjects based solely on automated processing, including profiling, that produce legal effects or similarly significantly affect them.

12. Updates to this notice

This notice may be updated if the manner of processing, the scope of services, the tools used or applicable laws change.
